"The noise and fanfare of the traditional Fourth of July celebration ended in tragic silence yesterday for a Chicago high school student.
Benny Stewart, 17, of 1866 Central Park ave., a student at Cregier High school, was fatally shot by a .44 caliber Remington rifle that was being held by his chum Waddell Lee Haynes, 16, of 9712 Union ave.
The tragedy in the Haynes home came while the two boys were alone. The rifle, was taken from under the bed of Mrs. Haynes.
According to Waddell’s statement to police, the boys brought the rifle into the parlor, and after examining it, Benny placed the gun on a couch saying he had inspected it and found the chamber empty.
Waddell said Benny then went into the bathroom to wash his hands while former toyed with the gun. Waddell pulled the trigger with the gun pointed in the direction of the victim. The bullet struck Benny in the forehead. Stewart was pronounced dead at Little Company of Mary hospital.
The Haynes boys summoned police after the shooting and was taken for questioning.
Meanwhile, Herbert Weatherspoon, 16, of 5720 Princeton, Englewood High school student, was shot in the right ankle when his brother James, 18, picked up a zip gun in their front lawn.
At Provident hospital, Herbert was considered in good condition."
