"NEWPORT, R.I.-- The expected suit against the city by the Newport Jazz Festival jelled here with notice of a claim for $450,000 in damages arising from cancellation of the jazz bash program following the riots of July 2. Counsel for the Newport Jazz Festival Inc., in registered letter to the City Treasurer and the City Council, gave notice of the claim. Under Rhode Island law, first notice of such as claim must be served on the city. The city has 40 days to honor or disclaim the claim for damage before court action may be taken.
Atty. Morris Kirsner of Boston charged Newport Jazz Festival “was unable to perform and fulfill its contracts with numerous artists for whose services contracts had been executed for the full period of the license and further was unable to perform and fulfill its contracts with innumerable ticket holders for the performance scheduled for July 3 and July 4.”
“The reputation and world-wide fame of the Newport Jazz Festival, Inc., and its promotions in the City of Newport, Rhode Island, and elsewhere have been irreparably affected and sustained other financial loss all to its great damage, presently amounting to $450,000.” Kirsner wrote.
More than 50 persons were injured and 200 arrested in the riots which were broken up after 100 National Guardsmen were ordered to the scene."
